PLEASE READ CAREFULLY:
In consideration of the services provided by Ocean Rentals Ltd and/or Sandbridge Eco Sports Inc. DBA Surf & Adventure Co. , I agree as follows:
ACKNOWLEDGEMENT OF RISKS: I realize that there is an inherent danger in the use of any watercraft and that the use of such craft in or upon the water may involve hazards including but not limited to: deep water; submerged objects; other watercraft including jet skis, power boats, and the people or objects they may tow; changing currents; severe weather including high winds, extreme heat or cold, and unexpected lightning; equipment failure; and my inability to control the craft. I realize that these risks can pose a threat to my safety, that these and other factors can result in collision, upset, overturn and/or sinking and could cause me to get wet, injured, exposed to the elements and/or drowned. I realize that I may suffer accidents or illness and that personal property may be lost or damaged. I acknowledge that risks, dangers, and hazards may be unpredictable and may change recommended precautions and procedures without notice.
EXPRESS ASSUMPTION OF RISKS AND RESPONSIBILITY: In recognition of the inherent risks of the activity in which I or any minor children for whom I am responsible may engage, I confirm that I am (we are) physically and mentally capable of participating in the activity and using the equipment. I/we participate willingly and voluntarily, and I assume full responsibility for personal injury, accidents or illness, including death. Personal injury, accidents or injury could include, but are not limited to: sprains, torn muscles and/or ligaments; fractures; cuts, wounds, abrasions and/or contusions; dehydration, drowning; oxygen shortage; exposure; head, neck or spinal injuries; animal or insect bites or attack; allergic reaction; shock; paralysis; and/or death. I assume all responsibility for damage to or loss of personal property as the result of any accident that may occur.
COVENANT OF GOOD FAITH: I recognize that Ocean Rentals Ltd and/or Sandbridge Eco Sports Inc. DBA Surf & Adventure Co. as the provider of services, will operate under a covenant of good faith and fair dealing, but that it may be to terminate an activity due to forces of nature, medical necessities or other problems. I accept that Ocean Rentals Ltd and/or Sandbridge Eco Sports Inc. DBA Surf & Adventure Co. may, at staff’s judgment, refuse or terminate the participation of any person deemed to be a safety hazard to themselves or other participants, either by their behavior or lack of ability to meet requirements of participation or to follow staff direction.
AUTHORIZATION: I hereby acknowledge any emergency medical treatment deemed necessary in the event of any injury while participating in the activity. I either have appropriate medical insurance or, in its absence agree to pay all costs of rescue and/or medical services as they may be incurred on my behalf.
RELEASE OF LIABILITY: In consideration of services or property provided, I, for myself and any minor children for which I am responsible, any heirs, personal representatives or assigns, do hereby release SANDBRIDGE ECO SPORTS and their officers, directors, agents, or employees and volunteers, and every land owner, municipal and/or governmental agency upon whose property an activity is conducted, from all liability, and waive any claims for damage arising from any cause whatsoever including that which is the cause of gross negligence.
I have read the foregoing acknowledgement of risks, assumptions of risks and responsibility, and release of liability. I understand by signing this document I may be waiving valuable legal rights.
